Terms of Service

These Terms of Service ("Terms") govern your access to and use of Menulisa (the "Service"), including our websites, dashboards, point-of-sale, and guest-facing QR menus. By creating an account or using the Service, you agree to these Terms.

If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms, and "you" refers to that business.

You are responsible for the information you provide, for keeping your login credentials and staff PINs secure, and for all activity that occurs under your account.

You must be at least 18 years old and able to enter a binding contract to use the Service. Notify us promptly of any unauthorised use of your account.

You agree not to misuse the Service. In particular, you will not:

• Break the law, infringe others' rights, or sell prohibited or unsafe goods through the Service.
• Upload malicious code, attempt to gain unauthorised access, or probe or disrupt the Service or its infrastructure.
• Reverse-engineer, resell, or white-label the Service except as expressly permitted in writing.
• Misrepresent menu items, allergens, pricing, or your identity to guests.

The Service helps you take orders and accept payments from your guests. You are the merchant of record for those transactions and remain responsible for fulfilment, taxes, refunds, and compliance with payment-network rules.

Card payments are processed by third-party providers (such as Stripe). Your use of those services is subject to their terms.

Subscription fees, if any, are described on our pricing page and billed in advance. Fees are non-refundable except where required by law.

You retain ownership of the menus, images, branding, and other content you upload (“Your Content”). You grant us a limited licence to host, process, and display Your Content solely to provide the Service.

You are responsible for having the rights to Your Content and for its accuracy, including menu descriptions, prices, and allergen information shown to guests.

We work to keep the Service available and reliable, including offline-tolerant ordering, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features with reasonable notice where practical.

The Service, including its software, design, and trademarks, is owned by Menulisa and its licensors and is protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership to you.

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk or legal exposure, or fail to pay fees due.

On termination, your right to use the Service ends. We may delete your data after a reasonable retention period, subject to our Privacy Policy and applicable law.

The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law.

To the fullest extent permitted by law, Menulisa will not be liable for indirect, incidental, or consequential damages, or for lost profits or revenue; and our total liability arising out of the Service is limited to the fees you paid in the 12 months before the claim.

We may update these Terms from time to time. Material changes will be communicated through the Service or by email, and continued use after changes take effect constitutes acceptance.
